1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of services provided by Shine Car Detailing Inc., doing business as Shine Vehicle Care ("Shine," "we," "our," or "us").

By using our website, mobile application, or on-site vehicle care services, you agree to be bound by these Terms.

If you do not agree, you may not use our services.

2. Description of Service

Shine provides on-site vehicle care services within residential communities as a property-approved amenity.

Our services include:

  • Scheduled service days ("Shine Days") at participating properties
  • Exterior and interior vehicle cleaning using a 100% waterless process
  • Subscription-based and one-time service options
  • Booking, scheduling, and account management via our platform
  • Customer communication and support

Services are performed where vehicles are parked and do not require relocation by Shine staff.

3. Eligibility & Property Participation

  • Services are available only at participating residential communities
  • Users must confirm their property is within an active Shine service area
  • Shine reserves the right to approve or deny service based on property eligibility

4. User Accounts

To access certain features, you must create an account.

You agree to:

  • Provide accurate and current information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of unauthorized use

4.1 Email Notifications

By creating an account or using Shine services, you agree that we may send email communications needed to operate and support the service, including confirmations, scheduling updates, billing notices, receipts, account alerts, policy updates, and support responses.

These operational emails are an essential part of the service relationship. Marketing emails, where applicable, may be managed through your communication preferences.

4.2 SMS & MMS Notifications

You also agree that Shine may send SMS and MMS messages for essential service communications, including reminders, day-of-service notices, status updates, account security notifications, and urgent service changes.

These messages support timely coordination and delivery of services. Message frequency may vary, and message/data rates may apply based on your carrier plan.

5. Service Terms

5.1 Shine Days

  • Services are performed only on scheduled Shine Days at your property
  • You are responsible for ensuring your vehicle is accessible on scheduled days
  • If interior service is requested, the vehicle must be unlocked at the time of service
  • If a vehicle is locked, Shine may still perform exterior-only service

5.2 Vehicle Condition & Access

By booking a service, you agree:

  • Your vehicle is safe to service
  • There are no hazardous materials or unsafe conditions
  • You grant Shine permission to access the vehicle only for the duration of service

Shine does not take custody of vehicles and does not move vehicles.

5.3 Missed Services

  • If your vehicle is unavailable, locked (for interior), or cannot be located, the service may be skipped
  • Subscription services may resume on the next scheduled Shine Day
  • Refunds are not guaranteed for missed services due to user unavailability

6. Booking, Billing & Payments

6.1 Payments

  • Payments are processed through secure third-party providers (e.g., Stripe)
  • You authorize all charges associated with your bookings or subscriptions
  • Pricing may vary by property and service type

6.2 Subscriptions

  • Subscription plans renew automatically based on your selected plan
  • You may cancel or modify your subscription at any time before the next billing cycle
  • No partial refunds are provided for mid-cycle cancellations unless otherwise stated

6.3 One-Time Services

  • One-time services are charged after service completion or as otherwise specified
  • Service availability is not guaranteed outside scheduled Shine Days

7. Cancellations & Rescheduling

  • Changes or cancellations must be made prior to the scheduled Shine Day cutoff
  • Missed or late cancellations may result in loss of that service occurrence
  • Weather or operational issues may result in rescheduling at no additional cost

8. Service Limitations

Shine uses a waterless cleaning process designed to safely clean vehicles without hoses or runoff.

However:

  • Results may vary based on vehicle condition
  • Certain contaminants (e.g., heavy mud, excessive buildup) may limit effectiveness
  • Shine reserves the right to decline service if conditions are unsuitable

9. Liability Disclaimer

To the maximum extent permitted by law:

  • Shine is not responsible for pre-existing damage to vehicles
  • Shine is not liable for indirect, incidental, or consequential damages
  • Shine's total liability shall not exceed the amount paid for the specific service

10. Indemnification

You agree to indemnify and hold harmless Shine Car Detailing Inc. from any claims arising from:

  • Your use of the service
  • Violation of these Terms
  • Misrepresentation of vehicle condition

11. Acceptable Use

You agree not to:

  • Provide false or misleading information
  • Interfere with service operations
  • Attempt unauthorized access to our systems
  • Use services in violation of applicable laws

12. Intellectual Property

All content, branding, and systems are owned by Shine Car Detailing Inc.

You may not:

  • Copy or reproduce materials
  • Use branding without permission
  • Reverse engineer our systems

13. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms.

14. Termination

We may suspend or terminate access to our services at any time for:

  • Violation of these Terms
  • Fraud or abuse
  • Non-payment
  • Disruptive behavior

15. Governing Law

These Terms are governed by the laws of the State of Texas.

Any disputes shall be resolved in the appropriate courts located in Texas.

16. Changes to Terms

We may update these Terms at any time.

Updates will be communicated via:

  • Website updates
  • Email notifications (if applicable)
  • Platform notices

Continued use of our services constitutes acceptance of the updated Terms.
